固定期限劳动合同终止的人力资源管理研究

摘要


终止固定期限的劳动合同要分情况对待,对于只订立一次固定期限的劳动合同,合同到期后劳动者和用人单位均有权终止合同,基于不续签的原因,判断用人单位是否需向劳动者支付经济补偿。对于连续订立二次固定期限劳动合同的情况,期满后劳动者享有是否续订的选择权。对于用人单位而言,只要劳动者提出续订无固定期限劳动合同,就应当与其订立。合同到期后,无论何种原因导致的终止不续签,劳动者都可以申领失业保险金。

On this basis, this paper proposes a series of solutions, including improving the legal and regulatory system, improving the quality of employees, promoting the scale and professional development of enterprises, coping with the impact of population aging and family structure changes, etc., aiming to comprehensively promote the improvement of the overall quality of the industry and the improvement of service quality through policy support, vocational training and digital transformation.
